ABOUT WORKING HOURS IN 2006

In accordance with Article 124 of the Labor Code of the Republic of Belarus (hereinafter referred to as the Code), for each calendar year the Government or its authorized body establishes the estimated working time norm.
Based on the Regulations on the Ministry of Labor and Social Protection of the Republic of Belarus, approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 31, 2001 N 1589 "Issues of the Ministry of Labor and Social Protection of the Republic of Belarus" as amended by the Resolution of the Council of Ministers of the Republic of Belarus of February 7, 2005 N 127, the estimated norm of working time for each calendar year is established by the Ministry of Labor and Social Protection.
For 2006, the estimated norm of working time was established by the Decree of the Ministry of Labor and Social Protection of the Republic of Belarus dated October 4, 2005 N 127.
With a full norm of working time of 40 hours per week, the estimated norm of working time for 2006 for a five-day working week is 2020 hours, for a six-day working week - 2022 hours.
The calculation of the estimated norm of working time was carried out in accordance with the calculation procedure provided for by the Decree of the Ministry of Labor of October 18, 1999 N 133. The norm is set for a five-day working week with days off on Saturday and Sunday and for a six-day working week with a day off on Sunday. The calculation was made on the basis of the full norm of working hours of 40 hours per week (Article 112 of the Code).
In 2006 there are 365 calendar days and 52 calendar weeks. With a five-day working week in the named year there will be 253 working days, and with a six-day working week - 304 (12 calendar months are taken into account).
When determining the norm, days off from the number of calendar days are excluded according to the calendar of a five-day or six-day working week, as well as the days of state holidays and public holidays, which are established by Decree of the President of the Republic of Belarus of March 26, 1998 N 157 and paragraph 3 of the said Decree are declared non-working days ( hereinafter referred to as public holidays). Of the 9 non-working holidays, eight are celebrated on the days established by the above Decree, and the ninth holiday Radunitsa (according to the calendar of the Orthodox denomination) is celebrated on a certain day, depending on the date of the religious holiday of Easter, also according to the calendar of the Orthodox denomination in the corresponding year. Let's name non-working holidays in 2006.

8 2006, according to the calendar of a five-day working week, out of nine holidays, two coincide with days off on Saturday and Sunday (January 1, January 7), and with a six-day working week, one holiday coincides with a day off on Sunday (January 1). Article 139 of the Code establishes that if days off coincide with holidays, the day off is not transferred and another day of rest is not provided. If an employee works on holidays coinciding with days off, then compensation for work on such days is made in accordance with the rules established by part three of Article 69 and Article 148 of the Code.
When determining the estimated norm of working time, it was also taken into account that, in accordance with Article 116 of the Code, the duration of work on the eve of public holidays is reduced by one hour.
The established estimated norm of working time is applied when planning and accounting for the working time of employees with a shift work regime and with a summarized accounting of working time. At the same time, it should be taken into account that not in all cases the estimated norm of working time can be applied in relation to a specific employee who, during the calendar year or in certain periods of the year, according to different reasons did not work (due to temporary disability, labor leave, for other reasons). In this regard, on the basis of the calculated norm, the employer ensures the determination of the norm of working hours for a particular employee.
For example, an employee entered into an employment relationship with an employer on January 10, 2006. With the total accounting of working time with a quarterly accounting period for this employee, the working time norm of the first quarter will be 47 hours less than the calculated norm (8 x 5 + 7 x 1). In the schedule of work (shifts) working time this employee is planned taking into account its norm in the first quarter, equal to 463 hours (510 - 47).
The published production calendar of 2006 provides the estimated working time norm for each month of the year with a full working time norm of 40 hours per week (Article 112 of the Code) and with a reduced working time norm of 35 hours per week established for certain categories of workers (Articles 113 and 114 of the Code). ).
In 2006, the average monthly number of working days with a five-day working week was 21.08 days, and with a six-day working week - 25.33 days. When calculating the average earnings retained during the vacation, the permanent value of the average monthly number of calendar days 29.7 is applied. This value does not depend on the annually changing number of working days.
With a working time norm of 40 hours per week, its average monthly calculation norm, which is used primarily in planning the number of employees, for 2006 for a five-day working week is 168.3 hours, for a six-day working week - 168.5 hours.
In accordance with Article 61 of the Code, employees may be paid at hourly or monthly tariff rates (salaries).
When determining the amount of wages based on hourly tariff rates, the employer establishes the procedure for their calculation.
It should be borne in mind that if hourly tariff rates are calculated on the basis of the average monthly norm of working time, determined taking into account the estimated norm of working hours established for the corresponding calendar year, then in this case the hourly tariff rates and piece rates must be recalculated annually.
This is due to the fact that the value of the estimated norm of working time of the calendar year changes annually, and consequently, the value of the average monthly norm of working time of the corresponding calendar year also changes.
In this regard, the employer has the right to establish the average monthly norm of working time as a constant value, which can be determined on the basis of the estimated norm of working hours for a number of calendar years (for example, for 5 or 10 years).
As a rule, to determine the amount of compensatory payments for overtime work, on weekends, on holidays, hourly tariff rates are determined on the basis of the estimated norm of working hours of a particular month.

Article 95 of the Labor Code of the Russian Federation provides for a reduction by one hour of the length of the working day or shift immediately preceding a non-working holiday. There is no longer an exception for employees with a reduced workweek, which was the case earlier in Article 47 of the Labor Code of the Russian Federation.

Decree of the Government of the Russian Federation of November 6, 2001 N 767 "On the transfer of days off in 2002" provides for the transfer of days off from Saturdays April 27 and May 18 to Fridays May 3 and 10, from Sundays November 10 and December 15 to Fridays November 8 and 13 December.

In accordance with the current procedure, the norm of working time for certain periods of time is calculated according to the calculated schedule of a five-day working week with two days off on Saturday and Sunday, based on the following duration of daily work (shift):

with a 40-hour work week - 8 hours;

If the duration of the working week is less than 40 hours - the number of hours obtained by dividing the established duration of the working week by five days;

On the eve of non-working holidays, the working time is reduced by one hour.

The norm of working time calculated in the specified order applies to all modes of work and rest.

For example, in February 2002, with a five-day working week with two days off - 19 working days and 9 days off, including one pre-holiday day shortened by one hour on February 22, as well as one additional day off on February 25 due to coincidence with the holiday Saturday afternoon of a non-working holiday on February 23 - Defender of the Fatherland Day (Article 112 of the Labor Code of the Russian Federation).

The working hours for this month are:

with a 40-hour work week - 151 hours (8 hours x 19 days - 1 hour);

with a 36-hour work week - 135.8 hours (36 hours: 5 days x 19 days - 1 hour);

with a 24-hour work week - 90.2 hours (24 hours: 5 days x 19 days - 1 hour).

In 2002, with a five-day working week with two days off, 250 working days, including 8 pre-holiday days (February 22, March 7, April 30, May 8, June 11, November 6, December 11 and 31), and 115 days off , including 11 non-working holidays (January 1, 2 and 7, February 23, March 8, May 1, 2 and 9, June 12, November 7 and December 12).

The norm of working hours in 2002, taking into account the above, is:

with a 40-hour work week - 1992 hours (8 hours x 250 days - 8 hours);

with a 36-hour work week - 1792 hours (36 hours: 5 days x 250 days - 8 hours);

With a 24-hour work week - 1192 hours (24 hours: 5 days x 250 days - 8 hours).
